Terms of service
Last updated: to be set on publication.
Before you publish this: fill in the bracketed entity and jurisdiction details, and have a lawyer read it. Consumer law in the UK and EU limits what terms like these can actually do — particularly around refunds, the 14-day right to cancel, and any attempt to exclude liability — and those limits apply whatever this page says.
1. Who you are dealing with
Won't Fit is provided by [LEGAL ENTITY NAME], [COMPANY NUMBER], of [REGISTERED ADDRESS] ("we", "us"). Using Won't Fit means accepting these terms.
2. Your account
You can use Won't Fit without an account. If you make one, give a real email address, keep your password to yourself, and tell us if you think someone else has got into it. You must be old enough to enter a contract where you live — at least 13, and at least 16 in countries that set the age there.
3. What you make is yours
The rooms you draw are yours. We claim no ownership of them and no right to use them for anything except storing them and showing them back to you on your devices, which is what sync is. We do not look through them, sell them, or train anything on them.
Won't Fit itself — the app, the object library, the site — stays ours.
4. Plus subscriptions
- Plus is a recurring subscription, billed monthly or yearly until you cancel. Prices are shown before you buy and include tax where we are required to charge it.
- Cancelling takes effect at the end of the period you have already paid for. You keep Plus until then and are not billed again. Cancel from the account screen in the app.
- If a payment fails we will keep trying for a while, and Plus keeps working during that time rather than switching off the moment a card expires.
- Price changes apply from your next renewal, and we will email you at least 30 days beforehand so you can cancel first.
- If you subscribed through the App Store or Google Play, billing, cancellation and refunds are handled by Apple or Google under their terms, not here.
5. Refunds and the right to cancel
If you are a consumer in the UK or the EU you have 14 days from buying a subscription to change your mind and get a refund. Because Won't Fit is digital content supplied immediately, you are asked to agree to it starting right away; doing so can reduce that right, and where it does, any refund is pro-rated for what you have used. Outside those rules we will still deal with refund requests reasonably — write to support@wontfit.app.
6. What happens to your rooms if you stop paying
Nothing is deleted. Rooms already on a device stay on it and remain fully editable. What stops is syncing and the ability to create rooms beyond the free allowance. You can export a room to a file at any time while you have Plus, and we would encourage doing so before cancelling.
7. Fair use
Do not:
- try to break, overload, or get around the limits of the service;
- use it to store things that are not room designs;
- resell access, or share one account around an organisation;
- copy, decompile or rebrand the app.
We can suspend an account that does these things, and will say why.
8. Won't Fit is a planning tool, not a surveyor
This is the important one. Won't Fit works from the dimensions you give it. It cannot see your actual room, and it does not know about skirting boards, radiators, pipe boxing, a floor that is not level, a doorway you have to carry the sofa through, or a measurement you typed wrong. When Won't Fit reads a plan from a photograph it is interpreting a drawing, and it asks you for a real measurement precisely because a drawing has no scale of its own.
Measure before you buy, and check anything expensive or irreversible yourself. A fit check is an informed opinion about the model you built, not a guarantee about your room.
9. Availability
We aim to keep the service up but do not promise it always will be. The app is built to keep working offline for exactly this reason: if our servers are down you can still draw, edit and check every room on your device.
10. Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — including your statutory rights as a consumer, which these terms do not affect.
Beyond that, and to the extent the law allows: Won't Fit is provided as it is; we are not liable for indirect or consequential loss, and our total liability in any twelve-month period is limited to what you paid us in that period. If you are on the free tier, that is nil — which is another reason to check the measurements yourself.
11. Ending it
You can delete your account at any time from the app. We can close an account for a serious or repeated breach of these terms, with notice unless the breach makes that impossible.
12. Changes
We may change these terms. If a change materially affects you we will email account holders at least 30 days beforehand; carrying on using Won't Fit after that means accepting the new version.
13. Law
These terms are governed by the law of [JURISDICTION], and its courts have non-exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory law of the country you live in and can bring proceedings there.
